The decision on whether leave should be paid or not paid falls within the scope of practice of the human resources (HR) department. It is not the occupational health practitioner’s decision. There are different types of leave namely sick leave, vacation leave, family responsibility leave, study leave and special leave
Leave pay is governed by the Basic Conditions of Employment Act (Act 75 of 1997). The employer can have different leave requirements in their contract but not less than the BCEA.
